This policy describes how Teknor Apex Company, Inc., Rhode Island, USA ("Teknor Apex" "we" or "us"), will collect and make use of your data when you visit or submit data to us via our website www.teknorapex.com, www.apexhose.com and www.teknorautomotive.com   

Part 1: Applicable to All Users

What Information Do We Collect?

We collect and process personal data about you when you submit data to us via our website or otherwise interact with us and when you use our websites. This includes:

  • your name and the organization that you work for;
  • your job title, division, email address, phone and/or other contact details you may provide to us;
  • interests that you have expressed to us (e.g., in materials or processes or in speaking with specific contacts or roles within Teknor Apex);
  • your marketing preferences, including any consents you have given to us;
  • information related to the browser or device you use to access our website;
  • information regarding your use of our website;
  • if you are an existing customer, we also store information on Safety Data Sheets (SDS) that you have requested from us;
  • if you purchase stock color in our Teknor Color Store, we also collect your shipping address and billing address.
  • If you are a visitor to our European facilities, we collect your name, time of arrival and departure and signature, an acknowledgement of health as well as your temperature.

How Do We Use This Information, and What is the Legal Basis for This Use?

We process this personal data for the following purposes:

  • As required by Teknor Apex to conduct our business and pursue our legitimate interests, in particular
    • we will use your information to provide products and services you have requested, and respond to any comments or complaints you may send us;
    • we monitor use of our website, and use your information to help us monitor, improve and protect our network, facilities, products, content, services and websites.
  • Where you give us consent:
    • we will send you direct marketing in relation to our products and services or products and services provided by our affiliates (a list of our affiliates can be found below)
    • we place cookies and use similar technologies in accordance with our Cookies Policy, as set out below, and the information provided to you when those technologies are used.
    • on other occasions where we ask you for consent, we will use the data for the purpose which we explain at that time (such as during events).
  • For job application purposes in preparation for a potential employment contract:
    • we will process job applications that you submit via our website in order and as required to handle your application.
  • For purposes which are required by law: 
    • In response to requests by government or law enforcement authorities conducting an investigation.
    • We collect your information for track and tracing activities related to the pandemic when you visit our offices. You will receive more information on-site.

Withdrawing Consent or Otherwise Objecting to Direct Marketing

Wherever we rely on your consent, you will always be able to withdraw that consent, although we may have other legal grounds for processing your data for other purposes, such as those set out above.

You have an absolute right to opt-out of direct marketing at any time. You can do this by following the instructions in the communication where this is an electronic message, or by contacting us using the details set out below.

Who Will We Share This Data With, Where and When?

We may share your personal data with our affiliates (a list of our affiliates can be found below) based on our legitimate interest to have such of our affiliate respond to your requests that is best suited to support your interests and needs.

Depending on the nature of your request, we may decide that within our distribution system a distributor, rather than Teknor Apex or an affiliate of Teknor Apex directly, is best suited to help you. In this case, we will ask for your consent to share your personal data with one of our distributors in order for the distributor to respond to your request.

Personal data will also be shared with third party service providers, who will process it on behalf of Teknor Apex for the purposes identified above. In particular, we use third party service providers of website hosting and maintenance services and marketing agencies for digital marketing and automation services.

Where Do We Store Data, and for How Long?

Teknor Apex is a global company and may store your personal information in locations outside of your home country, including in the United States. These countries may have lower protections than those of your home country.  Teknor Apex applies similar protections to your data, regardless of the location.

It is Teknor Apex’s policy to retain data only for as long as needed for its stated business purposes and compatible purposes.

How Long Will You Retain My Data?

Where we process personal data for marketing purposes or with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). In any case, we will not retain or use your personal information longer than necessary for the purposes outlined in this Privacy Policy.

Pardot Marketing Automation

This website uses the Pardot Marketing Automation System by Pardot LLC, 950 East Paces Ferry Road, Suite 3300 Atlanta, GA 30326, USA („Pardot Marketing Automation System “). Pardot Marketing Automation System is a special software for capturing and analyzing movement profiles of website visitors. To the extent that personal data is processed by Pardot LLC the processing is exclusively at our orders and in accordance with our instructions.  

When you visit our website, Pardot Marketing Automation System records your click path and creates an individual user profile using a pseudonym. Once you provide us with your personal details, we may combine these with the pseudonymized user profile. For this purpose, cookies are used that enable the recognition of your browser.

You can deactivate the use of cookies at any time through the respective configuration of your browser. Set your browser so that no cookies from the domain “pardot.com” are accepted. However, this can lead to certain limitations in the functions and user-friendliness of our offer.

Privacy Notice for CA and NV residents

Collection, Use, and Disclosure of PI

We collect, use and disclose the following personal information as identified under each category of personal information, for business purposes identified and with the third parties identified below:

Identifiers: Name, postal address, online identifier, internet protocol address, email address, phone number.

Commercial information. Products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

Internet or other electronic network activity information.  Browsing history, search history, and information regarding a consumer’s interaction with an internet website, application, or advertisement.

Audio and Video: If you visit our facilities that employ CCTV, we may capture your likeness on video as you pass through secured areas.

Professional or employment-related information: Resume information if you apply for a job with us, and your current job role and employer if you work for a company doing business with us.

Education information: Resume information if you apply for a job with us.

Sources of Personal Information

We have collected the above categories and types of personal information directly from individuals through our website or during customer support contact, and through business documents such as our contracts and other shared documents. 

Use of Personal Information

We may use your personal information for the following business purposes: fulfill your requests and provide service, conduct business together, protect our legal interests, abide by our legal obligations, protect the security of our systems and facilities, analyze our business and web site performance, and market to you (with your consent).

Disclosure of Personal Information 

We may disclose your personal information with third parties for a business purpose.  These third parties include analytics providers and other service providers under contract to us. These service providers are prohibited from using your personal information except at our direction. Sale of Personal Information

We have not sold the personal information of CA or NV residents in the preceding twelve months. Right to Know and Right to Request Information

You may have the right to request that we disclose what personal information we collect, use, disclose or sell.  You have the right to request information about the personal information we’ve collected about you within the last twelve months.  You may request to know if we have collected, sold or shared with third parties for a business purpose the following information:

  • The categories of personal information we have collected about you
  • The categories of sources of personal information we collected about you
  • Our business or commercial purpose for collecting or selling personal information about you
  • The categories of third parties with whom we share personal information
  • The specific pieces of personal information we have collected about you
  • Whether we have sold your personal information and if so the categories of personal information that each category of recipient purchased; and
  • Whether we have disclosed your personal information for a business purpose and if so, the categories of personal information that each category of recipient received.

You may request this information no more than two times per year.

You have the right to request that we delete your personal information Under certain circumstances we may be unable to delete your personal information, for example, to comply with legal obligations, or to complete a business transaction that you have requested.

When you submit a request, we will verify your request and identity.  You may designate an authorized agent to make a request to know or a request to delete your personal information by providing the authorized agent written permission to do so; and by verifying your own identity with us directly.  We will deny any requests from agents that do not submit proof of authorization.
